1. Introduction

Welcome to Book The Move. These Terms of Use ("Terms") govern your access to and use of the services provided by Book The Move ("we," "our," or "us"), including our website at bookthemove.com and all related lead generation, data delivery, and email campaign services.

By signing up for our services or using our website, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

2. Services Overview

Book The Move provides AI-powered lead generation services for moving companies, including:

  • Furnished Leads: Daily delivery of furnished home listings with homeowner names

  • Furnished Leads+: Furnished home listings with verified homeowner contact information (phone and email)

  • Email Agent: Done-for-you email campaign management, including domain setup, inbox warming, and personalized outreach on your behalf

Services are provided on a per-county territory basis as described in your service agreement.

3. Account Registration

To use our services, you must:

  • Provide accurate and complete registration information

  • Maintain the security of your account credentials

  • Notify us immediately of any unauthorized access to your account

  • Be at least 18 years old and able to enter into legally binding contracts

You are responsible for all activity that occurs under your account.

4. Territory Exclusivity

How It Works

Email Agent plans include territory exclusivity on a per-county basis. This means:

  • Only one moving company may license each county at a time

  • Territories are assigned on a first-come, first-served basis

  • Exclusivity is maintained only while your subscription remains active and in good standing

Loss of Exclusivity

You may lose territory exclusivity if:

  • Your subscription lapses or is cancelled

  • Your account is terminated for violation of these Terms

  • Payment is more than 15 days past due

We reserve the right to reassign territories if exclusivity conditions are not met.

5. Payment Terms

Pricing

  • Furnished Leads: $97/month per county

  • Furnished Leads+: $197/month per county

  • Email Agent: $397/month per county

Pricing may vary based on listing volume in specific counties. Current pricing is confirmed during signup.

Billing

  • All plans are billed monthly via Stripe

  • Payment is due at the beginning of each billing cycle

  • You authorize us to charge your payment method on file automatically

Refunds

  • All payments are non-refundable

  • No prorated refunds for mid-cycle cancellations

  • If you believe you were charged in error, contact us within 30 days

6. Subscription Terms

Furnished Leads & Furnished Leads+

  • Month-to-month subscription

  • Cancel anytime with 30 days written notice

  • Service continues until the end of your current billing period

Email Agent

  • Minimum 3-month commitment

  • After initial term, continues month-to-month

  • Cancel anytime after initial term with 30 days written notice

Cancellation

To cancel your subscription, email us at robert@bookthemove.com with your cancellation request. Cancellations are effective at the end of your current billing period.

7. Acceptable Use

You Agree To:

  • Use leads only for your moving company's direct marketing purposes

  • Honor all unsubscribe and opt-out requests within 10 business days

  • Comply with all applicable laws, including CAN-SPAM, TCPA, and state telemarketing regulations

  • Maintain accurate caller ID and sender information in all outreach

  • Represent your moving company honestly and accurately

You Agree NOT To:

  • Resell, share, or distribute leads to any third party

  • Use leads for any purpose other than marketing your moving services

  • Send spam, misleading, or deceptive communications

  • Make robocalls or send automated texts without proper consent

  • Harass, threaten, or abuse any homeowner or contact

  • Use our services for any illegal purpose

  • Attempt to reverse-engineer, scrape, or copy our technology or data

Violation of these terms may result in immediate termination of your account without refund.

8. Email Campaign Terms (Email Agent)

If you subscribe to our Email Agent service, the following additional terms apply:

Our Responsibilities

  • Set up and manage sending domains on your behalf

  • Warm inboxes to establish sender reputation

  • Write and send personalized email campaigns

  • Monitor deliverability and adjust as needed

  • Forward replies to your designated email address

  • Maintain CAN-SPAM compliance for all campaigns

Your Responsibilities

  • Provide accurate business information for email content

  • Respond promptly to homeowner replies

  • Honor all unsubscribe requests

  • Notify us of any deliverability issues or complaints

  • Ensure your business is properly licensed and insured

Email Content

We write email content on your behalf based on listing information and your business details. You approve the general approach during onboarding. If you require approval of each individual email, additional fees may apply.

Compliance

All emails sent through our service include:

  • Clear identification of your company as the sender

  • Your physical business address

  • A working unsubscribe link

  • Accurate subject lines and headers

We reserve the right to pause or terminate email campaigns if we detect compliance issues, high spam complaints, or content that violates our policies.

9. Data and Lead Accuracy

Data Sources

Lead information is compiled from publicly available sources including real estate listing websites, county property records, and licensed data providers. We use AI to analyze listing photos and identify furnished homes.

No Guarantees

While we strive for accuracy, we do not guarantee:

  • That all leads will be accurate, current, or complete

  • That contact information will be valid or reachable

  • That homeowners will respond to outreach

  • Specific results, conversion rates, or booked moves

Lead generation results vary based on market conditions, your follow-up speed, and the quality of your sales process.

Your Due Diligence

You are responsible for verifying any information before relying on it for business decisions.

10. Intellectual Property

Our Property

All content, technology, software, data processes, and branding associated with Book The Move are our exclusive property or licensed to us. You may not copy, modify, distribute, or create derivative works without our written permission.

Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our services for your internal business purposes during your active subscription.

Feedback

Any feedback, suggestions, or ideas you provide about our services may be used by us without any obligation to you.

11. Limitation of Liability

Services Provided "As Is"

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Damages

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages

  • We are not liable for lost profits, lost revenue, or lost business opportunities

  • Our total liability for any claims arising from your use of our services is limited to the amount you paid us in the 1 month preceding the claim

Exceptions

Some jurisdictions do not allow limitations on implied warranties or liability. In such cases, the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Book The Move, its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

  • Your use of our services

  • Your violation of these Terms

  • Your violation of any law or regulation

  • Your outreach to leads provided through our services

  • Any claims by homeowners or third parties related to your marketing activities

13. Termination

By You

You may cancel your subscription at any time by emailing robert@bookthemove.com. Cancellation is effective at the end of your current billing period.

By Us

We may suspend or terminate your account immediately if:

  • You violate these Terms

  • Your payment method fails and is not updated within 15 days

  • We receive excessive spam complaints related to your campaigns

  • We believe your use of our services is harmful to our business or other clients

Effect of Termination

Upon termination:

  • Your access to our services and dashboard will be revoked

  • Your territory exclusivity will be released

  • You must cease using any leads or data obtained through our services

  • No refunds will be issued for any remaining subscription period

14. Dispute Resolution

Informal Resolution

Before filing any formal legal claim, you agree to contact us at robert@bookthemove.com and attempt to resolve the dispute informally for at least 30 days.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Jurisdiction

Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of such courts.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website

  • Sending an email to your registered address

  • Updating the "Last Updated" date at the top of this page

Your continued use of our services after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the changes, you must cancel your subscription before they take effect.

16. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any service agreements, constitute the entire agreement between you and Book The Move regarding your use of our services.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.
